Terms of Service

These Terms govern your access to and use of the Swatch Colors Ultimator Shopify app, including all content, features, and services available through the app (collectively, "Services").

By installing or using Swatch Colors Ultimator, you agree to be bound by these Terms. If you do not agree to all of the terms, you may not access or use our Services.

Who's Who

Throughout these Terms, "you" applies to any individual or entity that accesses or uses our Services. "We" or "Swatch Colors Ultimator" refers to the Swatch Colors Ultimator app and its owners.

Services Overview

Swatch Colors Ultimator is a Shopify app that allows merchants to add swatch buttons to their product pages and collection pages. No additional services, such as consulting or customer support, are offered outside of the app functionality.

Your Account

Our app is embedded within the Shopify environment and requires no separate account. Any basic user information collected is through Shopify.

You are responsible for maintaining the security of your Shopify account, and for any actions performed through it. Any issues, unauthorized access, or breaches of security should be immediately reported to Shopify.

Fees, Payment, and Renewal

Subscription Fees

Swatch Colors Ultimator is available via a subscription plan with a free trial period. All payments and invoices are handled directly through Shopify's payment gateway.

Automatic Renewal

Subscriptions are automatically renewed at the end of each billing cycle, as managed by Shopify. It is your responsibility to manage cancellations through your Shopify account prior to renewal. Failure to cancel will result in automatic charges, and no refunds will be issued for renewal payments.

Refunds

Subscriptions and payments for Swatch Colors Ultimator are non-cancellable and non-refundable, unless otherwise required by law.

User Responsibilities & Restrictions

You agree not to use Swatch Colors Ultimator for any illegal activities, or in violation of any Shopify policies or these Terms. This includes, but is not limited to, displaying illegal content using the swatches or using the app to promote unlawful activities.

Third-Party Services

Swatch Colors Ultimator integrates with third-party services, including Shopify's API and other third-party apps. By using Swatch Colors Ultimator, you acknowledge that we may share basic user data with Shopify and other integrated third-party services as necessary.

Intellectual Property

All content created by users, including swatch configurations and product assets, remains the property of the user. However, any swatch styles, templates, or code provided by Swatch Colors Ultimator remain the intellectual property of the app, and users may not reproduce or use these assets outside the app's intended functionality.

Termination of Service

You may terminate your use of Swatch Colors Ultimator by uninstalling the app from your Shopify store. Upon termination, all access to the app’s services will be revoked, and you are responsible for canceling any recurring payments through your Shopify account.

We reserve the right to terminate or suspend access to Swatch Colors Ultimator for any user who violates these Terms or fails to make the required payments, with or without prior notice.

Disclaimer of Warranties

Our Services are provided "as is" and "as available." We make no warranties, expressed or implied, regarding the app’s functionality, performance, or availability. Swatch Colors Ultimator is not responsible for any disruptions, errors, or issues resulting from the app’s use or interaction with third-party services, including Shopify.

You agree to use Swatch Colors Ultimator at your own risk. We are not liable for any loss of data, revenue, or functionality arising from the app's usage.

Jurisdiction and Legal Disputes

These Terms are governed by the laws of Québec, Canada. Any disputes arising from your use of the Services will be resolved in the provincial and federal courts located in Montréal, Québec.

Limitation of Liability

Swatch Colors Ultimator, its owners, or licensors shall not be held liable for any direct, indirect, incidental, or consequential damages resulting from your use or inability to use the app, including but not limited to errors, data loss, or failure of the app to function as expected.

Indemnification

You agree to indemnify and hold harmless Swatch Colors Ultimator and its affiliates from any claims, damages, or liabilities arising from your use of the Services, your violation of these Terms, or any content or data generated within the app.

Changes to Terms

We may update or modify these Terms at any time. Continued use of Swatch Colors Ultimator after changes are made will constitute acceptance of the revised Terms. If you disagree with any updates, you must discontinue using the app.

Miscellaneous

These Terms constitute the entire agreement between Swatch Colors Ultimator and you. If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in effect. You may not transfer your rights or obligations under these Terms to any other party without our consent.
